Terms of Service: HitDM

These terms apply to HitDM at https://hitdm.com (the "Service"), operated by AD Tech Services, India ("we", "us"). By using the Service you agree to these terms. If you don't agree, don't use the Service.

1. The Service

HitDM is an Instagram comment-to-DM automation app that sends links and optional lead forms via Meta's official API. Day-1 focuses on comment-to-DM with a tracked link and optional lead capture. The Service is offered as a new product and may change. We may add, change, or remove features. Free and paid DM allowances are shown on the pricing page and may change with notice.

Meta App Review status: HitDM has not completed Meta App Review. We do not claim Meta Partner, Business Partner, Tech Provider, or App Review approval. Instagram messaging features stay unavailable or limited until Meta approves the app and grants the permissions HitDM needs. We do not guarantee inbox placement, conversion rates, or App Review timelines.

2. Your account

You must be at least 18. You must be the owner of the connected Instagram account, or have explicit permission to manage it. One person or business per account; sharing a single HitDM login across unrelated businesses is not permitted. You're responsible for your account and for keeping your login secure. Give accurate information. We may suspend accounts that break these terms.

3. Acceptable use

Don't use the Service to break the law, infringe others' rights, send spam, upload malware, attack or overload the Service, scrape it, resell it without permission, or process data you have no right to process.

You must comply with Meta Platform Terms and Instagram messaging policies. Do not use HitDM to spam or send forbidden content. Automations stay paused until Instagram is connected and Meta app permissions are approved. Free and Pro DM meters apply; exceeding the meter pauses outbound DMs until the next period or an upgrade.

4. Subscription, billing, and cancellation

Paid plans are sold through our reseller and merchant of record, Dodo Payments, which handles checkout, taxes, invoices and refunds. Dodo Payments' buyer terms also apply to your purchase. Prices are shown on the pricing page. The Free plan does not require a card. Subscriptions renew automatically until cancelled. You can cancel anytime from the billing page; access continues until the end of the paid period. Refunds follow our Refund Policy at https://hitdm.com/refund.

5. Your content and audience data

You keep ownership of what you upload or create ("Your Content"), including automation rules, DM templates, links, and lead questions. You give us a limited license to store, process, and transmit it only to run the Service for you. You're responsible for having the rights to Your Content and for notices or consent for people who comment, receive DMs, or submit lead answers. For Instagram contacts, messages, and leads collected through your automations, you are the data controller and we are the processor.

6. AI features

This Service does not use AI features.

7. Service availability

We aim for the Service to be available but don't guarantee uninterrupted or error-free operation. Delivery of Instagram DMs depends on Meta. Outages or changes at Meta, Cloudflare, or Dodo Payments can affect the Service. We may perform maintenance or shut down the Service. If we shut down a paid Service, we'll give at least 30 days' notice and refund unused prepaid time.

8. Compliance with Meta

Your use of Instagram features depends on Meta Platforms, Inc. You must comply with Meta Platform Terms, Instagram Terms of Use, Instagram Messaging Policies, and related developer policies. If Meta suspends your account, app permissions, or API access, HitDM may stop working for that account. We are not liable for Meta outages, policy changes, App Review delays or denials, or enforcement by Meta or Instagram.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. HitDM is not affiliated with Meta, Instagram, or Facebook except as a third-party developer using their APIs.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, and our total aggregate liability is limited to the amount you paid us in the 12 months before the claim.

11. Termination

You can stop using the Service and delete your account anytime. You can disconnect Instagram anytime in HitDM Settings (Connected accounts → Disconnect). We may suspend or end your access if you break these terms or Meta policies. On termination we stop hosting Your Content and Meta tokens as described in the Privacy Policy and https://hitdm.com/data-deletion.

12. Changes

We may update these terms. For material changes we aim to give about 14 days' notice by email or in the app before they apply.

13. Governing law

These terms are governed by the laws of India. Courts in Bengaluru, Karnataka have jurisdiction, unless your local consumer law gives you other rights.
